Attacks against the rule of law have always been an integral of processes of de-democratization. The instrumentalization of law happens in an international context in which both authoritarian incumbents and their opponents try to use elements of the international legal and political framework for or against de-democratization.
In this debate by the CEU Democracy Institute on the rule of law conditionality mechanism recently adopted by the Council of the European Union and the European Parliament, the speakers, EU Commissioner Didier Reynders and Member of the European Parliament, Katalin Cseh, discussed the rationale for such a solution, the doubts of some European governments, as well as a more philosophical view on the EU’s competences in this matter.
